MRK Artistry LLC ("we," "us," or "our") owns and operates mrkartistry.com and other sites linking to these Terms of Use (individually, the "Site", and collectively, the "Sites"). Through the Sites, MRK Artistry LLC provides various offerings, information, and resources related to the products and services available on our Sites (each a "Service" and collectively, the "Services"). References to the Sites include the Services.

MRK Artistry LLC may change, suspend, modify, or discontinue all or any part of the Sites in its sole discretion with or without notice. MRK Artistry LLC is not liable if all or any part of a Site is, for any reason, unavailable at any time or for any period. MRK Artistry LLC reserves the right to block or deny access to any of the Sites to anyone at any time for any reason. MRK Artistry LLC is not obligated to correct or update any information or content on the Sites.

General Terms

These terms of use (together with any additional terms, as described below) ("Terms of Use") are an agreement between MRK Artistry LLC and the individuals that use the Sites (or the parent/legal guardian of any such individuals under the age of 18) ("users," "you," or "your"). The Terms of Use govern your access to and use of the Sites. Subject to your full and ongoing compliance with these Terms of Use, MRK Artistry LLC hereby grants you a limited and revocable right to access and use the Sites, solely for their intended purposes. If you use or access the Sites on behalf of a business or other entity, you must have authority to bind that business/entity. In such case, the term "you" includes the business/entity and any of its agents that use or access the Sites. IF YOU ARE UNDER THE AGE OF 18 (A MINOR), YOUR PARENT OR LEGAL GUARDIAN MUST READ AND CONSENT TO THE TERMS OF USE BEFORE YOU USE THE SITES. BY PERMITTING A MINOR TO USE THE SITES, THE MINOR'S PARENT OR GUARDIAN BECOMES SUBJECT TO THE TERMS OF USE AND AGREES TO BE RESPONSIBLE FOR THE MINOR'S ACTIVITIES ON THE SITES.

We may now or in the future offer multiple platforms (the "MRK Artistry LLC Platforms") through our Sites for use in accessing our Services. To use the Platforms, you must adhere to any additional terms and conditions specific to each Platform, as identified below and/or presented to you at the time you use the Platforms. Certain offerings on the Sites may be free of charge or offered for a fee, and we reserve the right to change what Services are offered free of charge or for a fee, and the fees charged for any given Service.

Changes to the Terms of Use

As stated above, MRK Artistry LLC reserves the right to update or modify the Terms of Use at any time, with or without prior notice. Any such changes will become effective upon the earlier of (i) the first time you use the Sites or Services with actual notice of the change(s), or (ii) 30 days after the change(s) are publicly posted on the Sites. Disputes arising under these Terms will be resolved in accordance with the version of the Terms of Use in place at the time the dispute arose. We use reasonable efforts to ensure that the Terms of Use identify the last date of update.

In the case of material changes to the Terms, MRK Artistry LLC will make reasonable efforts to notify you of the change, such as by sending an email to any address we have on file, displaying a pop-up window on the Sites, or other similar mechanism. We encourage you to review the Terms of Use frequently to stay informed of any changes.

Account Access and Security

You may be required to register and create an account to access some content and functionality on the Sites and/or Platforms. You may be required to provide personal information, such as an email and password, to create an account, as described in our Privacy Notice.

You are responsible for maintaining the confidentiality of your account, password, and other information. By creating an account, you agree that such account is intended for your use only, and you agree not to allow any other person to access it. You agree to notify MRK Artistry LLC immediately if you become aware of any unauthorized access to or use of your account. You may be required to log out from your account at the end of each session. MRK Artistry LLC is under no obligation to use, return, review, or respond to User Content. You understand and acknowledge that you are responsible for any User Content you post. By providing User Content, you represent and warrant that: (a) you own or control all rights in and to such User Content, (b) you have the right to grant MRK Artistry LLC the license to such User Content that is described above, and (c) the User Content you provide does and will comply with these Terms of Use, including the Content Standards below. You have full responsibility for such content, including its legality, reliability, accuracy, and appropriateness, as further explained in the Content Standards .

Reliance on Posted Information

The Sites may include content provided by persons or entities other than MRK Artistry LLC ("third parties"). Other than content provided by MRK Artistry LLC, all statements and/or opinions expressed, including all articles, responses to questions, and other content are solely the opinions and the responsibility of the party providing those materials. MRK Artistry LLC is not responsible for the content of any materials provided by third parties, and MRK Artistry LLC does not warrant the accuracy, completeness, or reliability of any such information. Information provided by MRK Artistry LLC on the Sites is informational only. MRK Artistry LLC does not guarantee the accuracy of information provided on the Sites.

Content Standards

You agree that you will not post any User Content that (a) infringes on or violates any intellectual property rights, (b) fails to comply with applicable laws and regulations, or (c) contains any expressions of hate, abuse, offensive images or conduct, or any similar content.   • involve commercial activities or sales, such as contests, sweepstakes, and other sales promotions, barter or advertising, other than as conducted by MRK Artistry LLC in its operation of the Sites; or

Governing Law and Jurisdiction

You agree that all matters relating to the Sites and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Pennsylvania without giving effect to any choice or conflict of law provision or rule (whether of the State of Pennsylvania or any other jurisdiction).

Shipping and Delivery

At this time, MRK Artistry LLC ships merchandise to locations within the United States and U.S. territories, including Alaska, Hawaii, Puerto Rico, Guam, and the US Virgin Islands. Additionally, MRK Artistry LLC ships merchandise to Canada and Mexico; international locations are by the discretion of MRK Artistry LLC management. If international shipment is requested please inquire by e-mailing [email protected]. The risk of loss and title for all merchandise ordered on this Web site pass to you when the merchandise is delivered to the shipping carrier.

International

Customs and import duties may be applied to international orders when the shipment reaches its destination. Such charges are the responsibility of the recipient of your order and vary from country to country. Contact your local customs office for details.

Shipping laws are different in each country. It is your responsibility to check with your Customs office to verify whether the country to which you are shipping permits the shipment of your products. MRK Artistry LLC is not responsible for any direct, indirect, punitive, or consequential damages that arise from improper international shipping practices.

Sales Tax

MRK Artistry LLC charges sales tax for merchandise ordered on this Web site based on the applicable state sales tax rate and the location to which the order is being shipped.

Stringed Instrument Warranty

LIMITED 7 YEAR WARRANTY — MRK Artistry LLC warrants this instrument to be free from defects in materials and workmanship for 7 years after its original purchase. This warranty does not include pickups, switches, jacks, controls, all other electronic components, tuning machines, hardware, pickguards, plated surfaces, cases and case hardware.

This warranty applies only to the original retail purchaser when this instrument is purchased from MRK Artistry Website or picked up locally from an authorized MRK Artistry LLC supplier, and is subject to the limitations set forth herein. It is important that you retain your original sales receipt as proof of purchase. If applicable, MRK Artistry LLC can identify non-warranty maintenance and should be the first point of contact when service of any kind is required for your MRK Artistry LLC instrument.

To receive warranty service, return the complete instrument to MRK Artistry LLC with your sales receipt as proof of purchase during the applicable warranty period. It is required that you have a conversation with MRK Artistry LLC prior to returning your instrument so you can be sure your issue is covered by MRK Artistry LLC's warranty. Defective components that qualify for coverage under this warranty will be repaired or replaced (at MRK Artistry LLC's discretion) without charge.

All transportation, insurance and freight charges associated with warranty service and repairs are the responsibility of the purchaser, as is any service initiated for the purpose of customizing setups or adjustments beyond factory specifications. Initial standard setup and adjustment of the instrument at the time of purchase are considered normal dealer product preparation and are not covered by this warranty.

Limitations and exclusions — The following items are not covered: fret wear • saddle wear • nut wear • strings and batteries • setups, adjustments or routine maintenance of any kind • damage to finishes or finish cracks • splitting or warpage of wood due to changes in temperature or humidity • exposure to or contact with sun, fire, moisture, perspiration, body salts and acids, guitar straps, guitar stands/hangers made from vinyl, plastic, rubber or other synthetic materials, or any other chemicals or polishes • damage, corrosion or rusting of any hardware components caused by humidity, salty air, or exposure to the moisture, body salts and acids of perspiration • damage to an instrument resulting from customization or modification • normal wear and tear on any part of the instrument or case including jacks, controls, switches, plated surfaces, tuning machines, pickguards, handles, latches, case hardware, etc. • all other damage and deterioration due to normal usage, wear and tear, aging, accidents, neglect, abuse, or Acts of Nature • shrinkage, cracking, or deterioration of plastic bindings • any instrument whose serial number is missing, altered or tampered with in any fashion • any instrument purchased from anyone other than MRK Artistry LLC • issues caused by service not performed by MRK Artistry LLC.

MRK Artistry LLC assumes no liability for property damage resulting from failure of this product nor any loss of income, satisfaction, or damages arising from the loss of use. MRK Artistry LLC reserves the right to change its warranty program at any time without prior notice to you.

Return Policy

You may purchase merchandise from this Web site by using any one of the payment options listed on our Payment Options page. MRK Artistry LLC reserves the right to change its payment procedures at any time without prior notice to you.

If you wish to return merchandise, all shipping charges and insurance are your responsibility. Upon receipt of the returned merchandise, if it is in good condition with no damage, MRK Artistry will have the option to refund your money. There is no guarantee of refund. All refunds must be agreed to by MRK Artistry LLC within 7 days of receiving the merchandise.

All returns must be discussed by e-mail to [email protected] prior to return/shipment. There will be no exceptions to this policy. All custom-built Guitars, Violins or Stringed instruments are non-returnable. All international orders outside the United States of America are non-returnable or refundable.

Miscellaneous

VOID WHERE PROHIBITED: Although the information on this Web site is accessible worldwide, not all products or services discussed in this Web site are available to all persons or in all geographic locations or jurisdictions. MRK Artistry LLC and the advertisers each reserve the right to limit the provision of their products or services to any person, geographic area, or jurisdiction they so desire and to limit the quantities of any products or services that they provide. Any offer for any product or service made in the materials on this Web site is void where prohibited.

GOVERNING LAW: In the event of litigation both parties agree that the Law of the State of business registration of MRK Artistry LLC shall apply and both parties shall consent to the jurisdiction of said State's courts, or in the event of diversity of citizenship, the United States District Court for the applicable District. Both parties expressly waive a trial by jury.
